Padilla

On
January 4, 2008, an eight month old
baby girl, A.M., was brought to St.
Elizabeth Medical Center North by her
parents because she was not using her
left arm which was swollen to nearly
three times the size of her right arm.
A preliminary examination by the ER
doctor indicated the child suffered
from a fractured left elbow.
Hospital staff called Covington Police
because they suspected possible child
abuse when the mother, Jessica
Padilla, gave varying accounts of how
the child was injured. Officer
Chris Dees responded and also received
various accounts of the baby's
injuries from Padilla. All of
the accounts involved hearing a
"pop" when she was picking
the child up. The baby's father
told Dees that he came home at 2:30
a.m. and found the child's arm
bruised, swollen, and immobile, so he
brought her to the hospital. The
baby was transported to Cincinnati
Children's Hospital Medical Center (CCHMC)
for treatment of the fractured elbow. Doctors
at CCHMC also diagnosed the baby
as having healing (older) fractures
of the left and right arms near the
shoulder, right arm near the wrist,
left femur (thigh), and left tibia
(shin). In addition, the baby
had a lacerated liver and suspicious
bruising around her mouth.
Veteran
Covington Police Detective Jim Coots brought
Padilla, who by then was pregnant with
another child, in for
interrogation. Padilla's
explanations continued to range from
various accidental causes to having
her eyes closed when the baby was
injured so she did not see how it
happened. Padilla never accused
anyone else of the injuries.
Padilla was arrested in March, 2008
and indicted in May, 2008 for Criminal
Abuse 1st Degree. After numerous
delays, the case was called to trial
on April 21, 2009 before Kenton
Circuit Judge Patricia Summe.
Asst.
Commonwealth's Attorneys Stefanie
Kastner and Laura Ward presented
testimony from Detective Coots, social
worker Lauren Mason of the KY Cabinet
for Families & Children, and
Covington Officer Bryan Bogard.
CCHMC Drs. Bennet and Tamai detailed
the baby's injuries and described the
surgery needed to repair the baby's
broken and dislocated elbow, including
the insertion of three surgical pins
to hold the joint together. The
baby's father also testified that he
and Padilla often argued over
Padilla's rough treatment of the baby.
The father testified that, in the
past, he had seen Padilla force feed
the baby, cover the baby's mouth when
she was crying, and jerk the child up
out of her crib. Police records
indicated he called police about
suspected abuse on at least one prior
occasion.
The
defense called no witnesses.
Padilla did not take the stand.
After the two day trial, the jury
returned a verdict finding the Padilla
guilty as charged. After
additional argument and testimony, the
jury then recommended that Padilla
serve the maximum ten year
sentence. Commonwealth's
Attorney Rob Sanders applauded the
work of the jury, Detective Coots, and
prosecutors Kastner and Ward.
"It's refreshing to see the
system work and justice served,"
said Sanders. "This case is
a perfect example of why we recognize
April as "Child Abuse Prevention
Month!""
On
June 9, 2009, Padilla appeared before
the court for final sentencing.
After hearing arguments from counsel
for the Defendant and the
Commonwealth, the Court followed the
jury's recommendation and sentenced
Padilla to the maximum ten year
sentence. Padilla will be
eligible for parole after serving only
20% of her sentence (2 years).
Baby A.M. and her new little sister
are in the custody of grandparents.

CAMPFIRE
SAFETY
When
thinking of the concept of
campfire safety, two things
come to mind. Unfortunately,
both of these things have to
do with television. The
first item on the agenda is
obviously Smokey the Bear.
"Only
you can prevent forest
fires," is the popular
saying by Smokey the Bear.
What this means is that 90% of
all forest fires are caused by
campers, who did not properly
put out their camp fires. One
must always remember but first
you have to smother the ashes
and spread them around to help
cool the campfire down. Once
you have done this, please do
not forget the poor water on
the ashes themselves. The
final item on that list, of
course, is once you have
completely done that, and
although you think the fire is
completely out, stir up the
ashes one more time to make
sure that it stays out.
Now
on a lighter note, when one
thinks of forest fires, they
think a Smokey the Bear. While
there are still some who have
seen a very crazy movie that
is entitled The Gods Must Be
Crazy. Now in this movie, if
you have not seen it before,
there is a rhinoceros. Now
according to the movie The
Gods Must Be Crazy, the
rhinoceros is the fire
preventer of the African bush.
Just
thinking about this movie and
a rhinoceros makes me chuckle.
For those who have not seen
the movie, I am not trying to
spoil it for you, so I have
only been to tell you about
the funding situation
involving the rhinoceros. In
this little section of the
movie, and runs up the tree,
but she did not see however,
is the rhinoceros stomping on
the campfire and putting it
out. When she climbs out of
the tree, she finds the other
conductor of the movie
stomping on the fire to ensure
that the campfire is out.
Since she did not actually see
the rhinoceros, she blamed the
other character for putting
the campfire out. Much like in
the states, the grizzly bear
is the fire prevention expert,
the African bush must also
have their protector and
according to this movie, the
rhinoceros is that protector.
But
now this is all besides the
point, but talking about fire
prevention out of a movie that
was made back in the 1970s.
Campfire safety is a very
serious matter. Every year
hundreds of thousands of
families lose their homes due
to brushfires that could've
been prevented had a little
campfire safety been utilized
when outdoors. Campfire safety
is no laughing matter. You
must always remember that when
you go camping, to ensure that
your campfire is completely
out before leaving the camp
site. Besides, how would you
feel if you lost your home due
to a fire that was caused by
somebody camping and not
insuring that the campfire was
completely out.
Remember
to spread the ashes around,
pour water on them and also
stir them up to ensure that
your camp fires out. It is
also a good idea to double
check your camp fire, about an
hour after putting it out to
make sure that it has cool
been sufficiently. Sometimes
as an extra precaution, don't
forget to bring a shovel with
you when you go camping, so
that you can put a load of
dirt on top of the campfire to
ensure that the campfire is
smothered.
